Rigid Visuals – Terms, Privacy & Payment Policies
Terms & Conditions
1. Services
Rigid Visuals LLC (“Rigid Visuals”), based in Miami, Florida, provides commercial photography, Matterport and non-Matterport virtual tours, drone imagery, mapping, disaster operations support, and consulting across the U.S., Latin America, and the Caribbean.
2. Scheduling & Turnaround
Services are available with as little as 12 hours’ notice. Typical fulfillment occurs within 10 business days depending on client coordination.
3. Cancellations & Refunds
All completed services are non-refundable. For unrendered services:
– Physical work: No charge if canceled 24+ hours in advance. 50% fee if canceled within 24 hours.
– Remote work: Cancelable prior to start. If already begun, billed at $150/hr.
4. Limitation of Liability
Rigid Visuals is not an engineering or architectural firm. Accuracy of scan data or mapping outputs is not guaranteed for legal or technical use. We are not liable for FAA restrictions, weather, public interference, or delays beyond our control.
5. Personal Liability Disclaimer
To the fullest extent permitted by law, neither Rigid Visuals LLC, nor its owners, employees, or contractors may be held personally liable for damages arising from services rendered. Clients acknowledge dealings are exclusively with Rigid Visuals LLC.
6. Ownership & Hosting
Matterport models are hosted on Matterport’s platform. Rigid Visuals does not host models. Final data is delivered digitally to the client.
7. Indemnification
Clients agree to indemnify and hold Rigid Visuals harmless from any claims arising from misuse, property access disputes, or third-party actions tied to the client’s direction.
8. Governing Law
All disputes shall be resolved through binding arbitration in Miami-Dade County, Florida. Each party bears their own costs. The prevailing party may recover legal fees at the arbitrator’s discretion.
9. Warranty Disclaimer
All services are provided “as-is,” with no express or implied warranties, including merchantability, fitness for purpose, or non-infringement.
10. Intellectual Property
All paid deliverables become the property of the client. Rigid Visuals retains the right to use non-confidential content in its portfolio, case studies, or marketing unless explicitly requested not to in writing.
Privacy Policy
1. What We Collect
We collect names, phone numbers, emails, business/location addresses, WhatsApp/social handles, and access codes when needed for service.
2. Use of Data
Your data is only used for operations and is shared with third-party contractors solely to fulfill your job.
3. Data Security
Client data is securely stored on encrypted platforms and is only accessible to authorized personnel.
4. Access Code Handling
Access codes are stored in internal calendar entries and archived within 5 days after job completion. We do not actively retain or reuse them.
5. Future Marketing
We may use limited customer data for ads (e.g., Facebook/LinkedIn). Opt-out options will be provided.
Payment Policy
1. Accepted Payments
ACH (preferred), credit cards, PayPal, and checks (not preferred).
2. Deposit Policy
– No deposit for jobs under $500
– 50% deposit required for jobs over $500
3. Terms
Balance due Net 15 unless otherwise stated in writing.
4. Late Fees
Invoices unpaid after 15 days incur a 1.5% monthly fee beginning on day 16.
5. Non-Payment & Termination
Rigid Visuals may withhold deliverables, remove content from portfolios, and suspend future work in the event of non-payment. Legal and collection fees will be charged to the client if pursued.
WordPress Data Practices
Comments
We collect the data shown in the comment form, and also the visitor’s IP address and browser user agent string to help spam detection. Comments may be checked via an automated spam detection service.
Gravatar
An anonymized string from your email may be sent to the Gravatar service to check if you’re using it. Gravatar’s policy is at automattic.com/privacy.
Media Uploads
Avoid uploading images with embedded location data (EXIF GPS) as others may extract this info.
Cookies
We use cookies for login, comment saving, and site functionality. These expire automatically based on your activity.
Embedded Content
Articles may include embedded content (e.g., videos, images) which behaves like visiting the original source site.
Data Retention
Comments and metadata are stored indefinitely. Users with accounts can see and edit their data (except username).
Data Requests
Users can request an export or deletion of their stored data (except for legal or admin records).
